During the second debate, Bush was asked who he would appoint to the Supreme Court. You may recall that he took that moment to come out against the Dred Scott case. You may also have read that this was code for Roe v. Wade. But what I wanted to say is that we treat the subject of Bush's judicial appointments as if it were hypothetical.

But in fact, although there have been no openings yet on the Supreme Court, Bush has been appointing federal court judges... oh, you know, I'm too tired and overwhelmed to write this up. Just go read Bob Harris's post.
